Depending on the reason for eviction, it may be that the issue can be resolved and you can remain in your home. If it is due to not paying your rent, your landlord may agree to a payment arrangement that would allow you to stay.
If your landlord has asked you to leave your home and you now face eviction, there is support available for you. As a tenant you have legal rights, and your landlord must follow the correct steps if they would like to you to leave.

Assured Shorthold Tenancies
In most cases, your landlord has to provide a valid written notice to evict you from the property. Most tenancies in the Private Sector are Assured Shorthold Tenancies which means you are entitled to a two-month notice period. Your landlord must obtain a possession order from court for you to be evicted. You can check what type of tenancy you have using Shelter’s tenancy rights checker.
If you have received a Section 21 notice, you can check if this is valid using Shelter’s website. If you have received notice, contact Housing Options for advice as soon as possible.
Licence Agreements
If you are a residential licensee, you are entitled to a 28-day notice period and your landlord needs to obtain a court order to evict you. Some types of licence are excluded from this procedure and only “reasonable notice” is required.
Licensees are still protected from harassment and illegal eviction by the Protection from Eviction Act 1977.
Lodger’s Agreement
If you rent a room in a property under a Lodger’s Agreement, your landlord does not have to go to court to evict you but should give you reasonable notice to leave.
Harassment and illegal eviction
If you are experiencing harassment from your landlord to make you leave your home, are being prevented from accessing the property or are being evicted illegally, please contact Customer Services to report your concerns immediately. Your landlord may be committing an offence and the Council will investigate and take action where appropriate.
