The Immigration Act 2016 was implemented on 1 December 2016 to prevent illegal working in the Hackney Carriage and Private Hire sectors.

You are no longer able to use a Biometric Residence Permit/Card or Frontier Worker Permit to evidence your right to work in the United Kingdom.

In order to assist the process please email your Right to Work documentation to driver.lic@wolverhampton.gov.uk and quote your WTP reference you are provided once your application has been submitted. You will need to produce all original documents when you collect your licence for verification.

It places a duty on local authorities to refuse to grant or renew a licence if the applicant cannot present documentation proving their right to work in the UK. A list of acceptable documentation can be found below.

How will it affect you?

On collection of your licence, you will be required to present your driving licence and a document showing your right to work in the UK. If you are unable to present the required documentation you will not be able to collect your licence.

Here you can transfer your visa to a current document.

If you do not provide the correct documentation within 6 months of your collection date, your application will be refused.

Home Office checking service

If you fail to present correct documentation on collection we will provide you with the option of our right to work checking service.

Licensing Services can conduct a check with the Home Office to ascertain your right to work status. Subject to the response received, we will be able to determine your application. You may have to repeat this process, depending on the reply received, until the correct documentation is provided. Original documents must be provided (certified copies will not be accepted).

There is a £125 administrative expense for new applicants and a £25 administrative expense for drivers that are currently licensed with us for us to conduct this check.

If you don't have any documents in List A or B below, you will need to either:

  • wait for your documents to return
  • use our Home Office checking procedure

If you use this procedure, we recommend you use it at least one month before the expiry of your licence. This will allow for any delays in receiving a response from the Home Office.

Lists of Acceptable Documents to Prove an Applicant’s Right to Work in the UK
  • All applicants must prove their right to work in the UK. Below is acceptable documentation proving a right to work in the UK. Ask the applicant for all documents that they have brought with them. Check which category the document is from and follow the instructions for that category. Scan and link all documents as ‘Immigration’ on Idox DMS.
     
  • List A: Applicants with a document from List A have a permanent right to work in the UK. If you retain a copy of these documents, you will not have to repeat the check when they subsequently apply to renew or extend their licence. 
  1. A passport (expired is acceptable, but you must not have cancelled your passport by cutting the corner) showing the holder, or a person named in the passport as the child of the holder, is a British citizen or a citizen of the UK and Colonies having the right of abode in the UK.
  2. A passport or passport card (expired is acceptable, but you must not have cancelled your passport by cutting the corner) showing that the holder is a national of the Republic of Ireland.
  3. Evidence of your Right to Work in the United Kingdom via a Right to Work Share code, stating that you have the right to reside in the United Kingdom indefinitely and can do the work in question. This can be provided via: www.gov.uk/prove-right-to-work
  4. A current Immigration Status Document issued by the Home Office to the holder with an endorsement indicating that the named person can stay indefinitely in the UK or has no time limit on their stay in the UK, and an official document giving the person’s permanent National Insurance number and their name issued by a Government agency or a previous employer. 
  5. A full birth or adoption certificate issued in the UK which includes the name(s) of at least one of the holder’s parents or adoptive parents and an official document giving the person’s permanent National Insurance number and their name issued by a Government agency or a previous employer. 
  6. A birth or adoption certificate issued in the Channel Islands, the Isle of Man or Ireland, and with an official document giving the person’s permanent National Insurance number and their name issued by a Government agency or a previous employer. 
  7. A certificate of registration or naturalisation as a British citizen and an official document giving the person’s permanent National Insurance number and their name issued by a Government agency or a previous employer.

    List B: Applicants with a document from List B have a temporary right to work in the UK. You will need to check their immigration status every time they collect their licence. Their licence will need to be re-issued by Licensing Services up to the expiry date of the document. This short-term licence can be extended - if the document is due to expire soon, they can either wait until their new document has arrived before collecting their licence, or accept the licence and contact Licensing Services to provide new proof of right to work in the UK. 

    Please advise applicants with documents in List B to apply for evidence of their Right to Work in the UK via a ‘share code’, which will make verification of their right to work in the UK quicker on renewal of their licence. If they do not apply for satisfactory documents, they may have to pay for the Home Office Checking Service every time they renew and their licence will not be issued until this has been complete.

     
  8. A current passport endorsed to show that the holder can stay in the UK and is currently allowed to do the type of work in question. If the passport has expired, they can use the Home Office Checking Service (£125 for new applicants and £25 for existing drivers*).
  9. Evidence of your Right to Work in the United Kingdom via a Right to Work Share code, stating that you have the right to reside in the United Kingdom on a current but time-limited basis and can do the work in question. This can be provided via: www.gov.uk/prove-right-to-work

List C: If the applicant has sent documentation from List A/B to the Home Office, they can either wait for their documents to be returned before collecting their licence or use the Home Office Checking Service (£125 for new applicants and £25 for existing drivers*). If the applicant has a document from List C, their licence will need to be re-issued by Licensing Services for six months. This short-term licence can be extended by providing new proof of right to work in the UK.
 

  1. A Certificate of Application issued by the Home Office under regulation 17(3) or 18A (2) of the Immigration (European Economic Area) Regulations 2006, to a family member of a national of a European Economic Area country or Switzerland stating that the holder is permitted to take employment which is less than 6 months old and Verification from the Home Office Evidence and Enquiry Unit. The licence may be granted for six months from the date of the Certificate of Application.
  2. A Verification issued by the Home Office Evidence and Enquiry Unit to you, which indicates that the named person may stay in the UK because they have an in-time application, appeal or administrative review and which is outstanding. The licence may be issued for six months from the date of the licence decision.
  3. A document issued by the Bailiwick of Jersey, the Bailiwick of Guernsey or the Isle of Man, which has been verified as valid by the Home Office Evidence and Enquiry Unit (Cost of £25 for existing drivers or £125 for new applicants), showing that the holder has been granted either unlimited or limited leave to enter or remain under Appendix EU to the Jersey Immigration Rules, Appendix EU to the Immigration (Bailiwick of Guernsey) Rules 2008, Appendix EU to the Isle of Man Immigration Rules.

This administrative expense is applicable from 01 April 2021. Any payments made to consult with the Home Office before 01 April 2021 will cost £125.00 for all applicants.
